By participating in this program, you ("user," "you," "your") agree to these Terms and Conditions ("Terms"), which supplement our main Terms of Service and Privacy Policy. Please read them carefully.

1. The Promise

Our guarantee is simple: if you consistently use the Body Byte app as intended for 60 consecutive days and do not achieve a measurable health outcome, we will provide you with a full refund of your subscription fee for the program period and grant you a free Body Byte Lifetime Premium Membership.

#### **2. Eligibility Requirements**

To be eligible to participate in The 60-Day Transformation Promise, you must:
*   Be a new Body Byte user with an active, paid subscription.
*   Be at least 18 years of age and a legal resident of the United States.
*   Formally enroll in "The 60-Day Transformation Promise" through the in-app prompt. Your 60-day period begins on the date of your first payment.
*   Not have previously participated in or claimed a reward under this Promise.
*   Consult a medical professional before beginning any new health, nutrition, or fitness program. Body Byte does not provide medical advice.

#### **3. Your Commitment: The Consistency Requirement**

To qualify for the guarantee, you must meet the following "Consistency Requirement" for **60 consecutive days** starting from your enrollment date:

*   **Daily Logging**: You must log at least one meal (via photo, text, or voice) within the Body Byte app for 60 days at least 5 days out of every week. The calories logged on each of those 5 days has to be at least 75% of your suggested calorie intake for that day.
*   **Daily Weigh-In**: You must log your weight at least 5 times per week through a smart scale integration.
*   **Profile Setup**: Your starting weight must be accurately recorded in your profile on or before Day 1 of your 60-day period.

A "day" is defined as a 24-hour period from 12:00 AM to 11:59 PM in your local time zone. The Body Byte app will automatically track your logging streak. It is your responsibility to ensure you complete a log each day.

#### **4. The "Measurable Health Outcome"**

A "Measurable Health Outcome" is defined as losing at least 8 pounds (or 5% of your starting weight, whichever is more achievable) weight within the 60-day period.

This will be verified using the weight logged on or before starting the the 60-day period and the final weight logged on or after Day 60.

#### **5. The Guarantee Payout**

If you have met the Consistency Requirement for 60 consecutive days and have not achieved the Measurable Health Outcome, you are eligible for the following:

*   **Full Refund**: A full refund of the subscription fees paid that cover the 60-day program period. The refund will be processed to your original payment method within 10-15 business days after your claim is approved.

#### **6. How to Make a Claim**

If you believe you are eligible for the guarantee, you must submit a claim within 14 days of completing your 60-day period.

To make a claim:
1.  Navigate to the "Settings" section of the Body Byte app.
2.  Select "Help & Support," then choose "60-Day Promise Claim."
3.  The app will automatically verify your logging streak and weight data. If the system confirms your eligibility, your claim will be automatically approved.
4.  If there is a data discrepancy, you may be asked to provide additional information or contact our support team.

All claims are subject to audit. Body Byte reserves the right to deny any claim that it reasonably determines to be fraudulent or in violation of these Terms.

#### **7. Disclaimers and Limitations of Liability**

*   **No Medical Advice**: Body Byte is a technology platform, not a medical provider. The information and features provided are for informational purposes only and are not a substitute for professional medical advice, diagnosis, or treatment. Individual results will vary.

*   **As-Is Service**: The Body Byte app and The 60-Day Transformation Promise are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, except as explicitly stated in these Terms.

*   **Data Accuracy**: You are responsible for the accuracy of the data you log in the app. The guarantee is based on the data you provide.

*   **Right to Modify or Terminate**: Body Byte reserves the right to modify or terminate this program at any time, for any reason, without prior notice. Any changes will not affect users who are currently enrolled in their 60-day period.
